ELIGIBILITY
The Contest is open only to individuals who are legal residents of Canada (excluding Québec) and who have reached the age of majority in their province or territory of residence at the time of entry. Employees, officers, and representatives (including immediate family/household members of such employees, officers, and representatives) of the Sponsor, its affiliates, subsidiaries, distributors, or advertising agencies are not eligible. In these Contest Rules, “immediate family/household members” includes the parents, siblings, children, partner and/or spouse of an individual.
By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules and accept the decisions of the Sponsor as final and binding, without right of appeal, in all respects, including without limitation as to eligibility and disqualification of entries. Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, in Sponsor’s sole discretion.
The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. By participating in this Contest, entrants understand that they are providing their information to the Sponsor and not to Instagram. The information provided will only be used for the administration of this Contest and in accordance with the Sponsor’s Privacy Policy and these Contest Rules. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Instagram.
CONTEST PERIOD
The Contest begins on June 4, 2025, at 12:00 a.m. Eastern Time and ends on August 31, 2025, at 11:59 p.m. Eastern Time (“Contest Period”), after which time the Contest will be closed and no further entries will be accepted.
HOW TO ENTER
There are two (2) ways to enter the Contest. Entrants may be awarded unlimited entries regardless of method during the Contest Period.
WITH PURCHASE
Entrants may earn entry(ies) to the Contest by:
1. making an Eligible Purchase during the Contest Period. In these Contest Rules, an “Eligible Purchase” means the purchase by an entrant of one (1) single can of Say It Ain’t Soda product, or the purchase of one (1) four (4)-pack of Say It Ain’t Soda product from a retail store; and
2. providing proof of the Eligible Purchase ( “Proof of Purchase”) (defined below), during the Contest Period, in the manner set out in these Contest Rules. To submit Proof of Purchase, entrants must complete the form available at: “https://docs.google.com/forms/d/e/1FAIpQLScaOzBoDbSBMJubPITk6pRk6MwRPawz-Yfd7jUz_iyebMzYyQ/viewform” and follow the on-screen instructions to: (i) provide all required information (including without limitation, first and last name, complete residential mailing address, a valid email address); and (ii) submit Proof of Purchase by uploading a copy of the entrant’s original store receipt showing the Say It Ain’t Soda product(s) purchased, the retailer’s name, transaction date and time, transactionsubtotal and transaction total dollar amount. To be eligible, the Proof of Purchase submitted must follow all requirements set out above. Failing to do so will result in disqualification.
Entrants will be awarded entries as follows:
1. One (1) entry for each purchase of one (1) can of Say It Ain’t Soda product.
2. Five (5) entries for each purchase of one (1) four-pack of Say It Ain’t Soda products.
The same Proof of Purchase cannot be submitted more than once in the Contest. Entrants must keep their original Proof of Purchase receipt. The Sponsor reserves the right to request from the original Proof of Purchase used for the purposes of this Contest and/or additional supporting images or information for further verification purposes at any time and for any reason. A failure to provide the original Proof of Purchase or additional documentation/information to the Sponsor within the timeline specified by the Sponsor may result in disqualification at the Sponsor’s sole and absolute discretion.
No Purchase Necessary (Mail-in Entry
Entrants may earn entry(ies) to the Contest, without purchase, by handwriting on a plain piece of paper:
1. Their first and last name, complete residential mailing address, and a valid email address; and
2. A fifty (50) word or more unique and original handwritten essay (for greater certainty, the entrant must personally complete the essay and must not copy their essay from any third party, or any part thereof, nor submit that same essay, or any part thereof, more than once) on the topic of What is Your Dream Tropical Vacation? Text must be in English.
The fully completed entry (in an envelope with sufficient Canadian postage) must be mailed to [8005 Alexander Rd Unit #1, Delta, BC V4G 1C6], which mail must be post-marked by no later than the end of the Contest Period and received by the Sponsor by [August 31st, 2025]. Entrants will be awarded one (1) entry per mail-in entry.
Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, delayed, destroyed, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. Entrants grant Sponsor a non-exclusive licence to use all entries for any purpose. No correspondence will be entered into except with Selected Entrants (as defined below). Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry. All entries are subject to verification by the Sponsor, in its sole discretion.
PRIZE
There is one (1) prize available to be won, consisting of one (1) cash prize of CDN$5,000.00, awarded in the form of a cheque to be applied toward a trip of the winner’s choice.The prize is non-transferable, non-exchangeable, and must be accepted as awarded. No warranties or guarantees are implied or expressed. Any federal, provincial, or local taxes, fees, or additional costs are the sole responsibility of the winner. The prize may not be sold to, bartered with, purchased by or utilized by a third party.The winner is solely responsible for any costs or expenses exceeding the $5,000.00 CAD prize and for booking and obtaining all necessary travel documents (such as passports or visas) that may be required for or incidental to the trip.
ODDS OF WINNING
The odds of winning depend on the number of eligible entries received before the Contest Period ends
SKILL-TESTING QUESTION
Selected Entrants will be required, as a condition of winning the prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question to be administered by telephone.
WINNER SELECTION AND NOTIFICATION
On or about September 5, 2025 (the “Draw Date”) the Sponsor, or an employee, agent or other representative of the Sponsor, will conduct a random draw from all eligible entries received during the Contest Period and select one (1) potential winner (“Selected Entrant”). The Selected Entrant will be deemed a winner if they meet all of the eligibility criteria set out in these Contest Rules. If a Selected Entrant does not meet the eligibility criteria, they will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible entries.
The Selected Entrant will be contacted by Instagram direct message, email or phone within five (5) business days of being selected.
Before being declared a winner, the Selected Entrant will be required to within five (5) business days of being contacted by the Sponsor:
A. acknowledge acceptance of the prize as awarded;
B. correctly answer the Sponsor’s time-limited mathematical skill-testing question without mechanical or other aid;
C. sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”); and
D. confirm compliance with all Contest Rules, all in the sole discretion of Sponsor.
If the Selected Entrant: (a) declines the prize; (b) fails to correctly answer the skill-testing question; or (c) fails to return the properly executed Contest documents within the specified time, then they will be disqualified (and will forfeit all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate eligible entry
PRIVACY & CONSENT
The Sponsor respects your right to privacy. Personal information (including an entrant’s name, address, email address, phone number, and any additional information or content required for the Contest, including to deliver the prize, or that an entrant otherwise provides, including social media handles, profile pictures and public posts or comments about the Contest on social media networks) collected from entrants will only be used by the Sponsor to administer the Contest and, only if consent is given at the time of entry, to provide entrants with information regarding upcoming promotions and/or events from the Sponsor. If an entrant is selected as a winner, the Sponsor may contact that entrantdirectly to request additional personal information needed to administer the Contest and award the prize. As an entrant of the Contest, the Sponsor may also share or otherwise publish the content you submit to the Sponsor.
By participating in the Contest, entrants consent to the use of their name, address, email address, postal code, telephone number, social media handle(s), comments and image, whether on videotape, photograph or any other means, for the administration of the Contest or any publicity carried out by the Sponsor, without further notice or compensation.

GENERAL CONDITIONS
By participating in the Contest, each Selected Entrant agrees to abide by these Contest Rules and the decisions of the Sponsor with respect to all aspects of the Contest. All entries become the property of the Sponsor upon receipt and will not be returned. The Sponsor reserves the right, at its sole discretion, to disqualify any individual (and all of their entries) who tampers with the entry process. Entries are subject to verification by the Sponsor. Entry materials/data not satisfying the entry requirements as set out in these Contest Rules, or that have been tampered with or altered are void.
The Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or any prize.
The Sponsor reserves the right to cancel, suspend, or modify the Contest if fraud, technical failures, or other factors impair the integrity or proper functioning of the Contest. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned, the Sponsor reserves the right to cancel the Contest.

If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by: (i) the individual assigned to the Instagram account entered at the time of entry, in the case of a Retail Store Entry; or (ii) the individual assigned to the email addressentered at the time of entry, in the case of a Mail-In Entry (in each case the “Authorized Account Holder”). Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder associated with a selected entry.
RELEASE AND INDEMNIFICATION
By participating in this Contest, entrants agree to release and hold harmless the Sponsor, Instagram, and their respective affiliates, officers, employees, and agents from any and all liability, claims, or damages arising out of participation or acceptance, use, or misuse of the prize.All winners must sign the Sponsor’s Winner Release to:
1. Confirm compliance with all Contest Rules;
2. Agree to accept the prize as awarded;
3. Release, discharge and hold harmless the Sponsor, Instagram, and their respective departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of entries by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of prizes as awarded; and
4. Indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize, and the use of entries by the Sponsor.
The Sponsor is and will not be responsible or liable for:
1. Incorrect or inaccurate entry information that may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Contest Rules;
2. Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;
3. Lost, incomplete, delayed, mutilated or misdirected entries or Winner Releases;
4. Injury or damage to entrants’ computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize;
5. Iny injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any related travel and the use of entries by Sponsor;
6. The security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or
7. Late, lost, misdirected or unsuccessful efforts to notify a potential winner.
RULE AMENDMENTS
The Sponsor reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond thereasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.
GOVERNING LAW
The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the Province of British Columbia, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Vancouver, British Columbia.
